WHAT SHOULD I DO AFTER I HAVE BEEN ARRESTED?

STEP 1:

Remain calm and give your co-operation to the SAPS but do not discuss any merits of the matter with them.

STEP 2:

Call your attorney to inform your attorney that you have been arrested or ask your friends or family members instead and ask them to call a criminal law attorney to help you to apply for bail on your behalf.  Your attorney will meet you at the holding cells to consult with you.

STEP 3:

Once you have been taken to the holding cells, a member of the SAPS known as an Investigating officer will interview you to complete the charging process by formulating the charge and / or charges against you and gather evidence.  It is important at this stage to do as your attorney advised you

STEP 4:

Once you have made contact with your attorney, you can do as the attorney advised you.  At this stage you will have to wait for your attorney as he or she will begin with the process of applying for bail.
